well me motor didnt last long turbo started whining on on wed took it straight bk to garage now sitting stripped waiting for warrenty company to pay for a new vf35 which is £1200 but are saying its not covered because it hasnt actually failed yet but was told if they put it bk on an drive it til it fails then it will take engine with it so im sure when they come out monday they will agree to pay 1200 rather than 4 or 5 grand for turbo and a new engine,fingers crossed she bk on the road mid week.

I would not trust a warranty company to pay for anything mate until they've actually done the work, normally their is so much crap in their small print they get out of paying for anything, have you read all the small print. Hope they do pay for it though and get your car sorted.

eye and av been assured off mate at garage that it will get sorted if the turbo had failed completely then it would of been sorted by now its just because it still works to why there is an issue doin me head in not havin a motor

Sorry to hear this Sid, bit of bad luck there.
Warrantys not worth the paper there written on comes to mind Shocked .

It would be cheaper just to buy you a quality 2nd hand one !

Don't be upset if they come back with the "wear n tear " phrase, warrantys are wank and the garages are bigger wanks too.

I have had experience with warranty companies and that's why i wouldn't buy from garagesunless the car was mega cheap !.

some crack these warrenty companys are they wont cover turbo because it hasnt failed so guess what ive got to do this is the heartbbreaking bit,ive got to drive it til it fails then it is covered and a new engine probably an all

I wouldn't take their word for it mate, if you drive it till its fucked they'll still try and get out of paying up somehow, warranties not worth the paper they are written on, had problems in the past with companies like that Evil or Very Mad might be better off just trying to get a second hand turbo if that's all that is wrong with it. Will the garage you bought it from not do anything.

Sid that is really crap news mate and I feel for you. Maybe one of the turbo experts like Jonny Gav can tell you what can make the turbo "fail quickly" or he might even be able to refurb it for you?

it it goes an i still get no where its simple he can keep car an get no money out of me at end of day the deal is done on a handshake and nothing official been thinkin about seein jonny for 1 but had already been told i will void warrenty totaly fook man my head is battered cause i so want to keep her its took me a long time to get a motor like this dont want to throw nearly 6 yrs of hard work away an end up with a scrapper again.

These warranty companies arnt worth jack so voiding the warranty shouldn't really be a problem. Either buy a cheap vf35 to replace the broken one or buy the upgrade turbo of your choice.. You wanted to get near to 400bhp so now you have the ultimate excuse..
I personally would go to see the garage you got the car from and explain the problem try to get some money off or refunded.. Good luck m8 with whatever you decide to do..

The garage should pay for the turbo if you tell them you don't want the car they will have to replace it anyway

The car has to be fit for the purpose for which it was sold and of merchantable quality.

If the garage sold you a Turbo car, then it's turbo should be in full working condition - the turbo not working, when sold as a turbo car is misrepresentation.

The onus is on them to repair it within at least the first 28 days warranty or no warranty - they have to by law give you their own warranty - usually longer on higher valued purchases.

Do them a letter stating the date purchased, the problem, what you want done and give them 7 days to respond to you from the date of your letter.

You must include:

The Sale of Goods Act 1979 makes it an implied term of the contract that goods be as described, fit for purpose and of satisfactory quality. As you are in breach of contract I am rejecting the ..(full title of the car).................... and request that you ..(what you want them to do - repair the car or cancel the sale).

Make sure you send it recorded delivery.

If money had changed hands and you didn't get a response within the timescale you would have had to lodge a claim at the small claims court for items under £5000 - but you'd need a solicitor for items over that amount.

Send it recorded delivery so you can track when they received it Very Happy - you can get Trading Standards involved but they'll tell you to write first.

got car back today an god she is ill but an agreement has been met that what ever goes will be replaced at no exspence to me what so ever weather that be just turbo or turbo and engine it is also stated in report (couldnt believe this myself when i read it)that the car is to be kept running until turbo failure has occured and will then therefore be covered.this is the way they have to do it as for any part they cover has to fail before they will replace it.yes it sounds a right load of shite but it was there in black an white.

according to warrenty who inspected it said its in working order but bloke who removed it said rear blades or something are catching slightly think thats what he said think i need another opinion from one of the gurus on here to drive the car to see what she is doin

Remove your air filter and put a ten mill nut in the pipe then rev your car up until it sucks it into the turbo. That will finish it off and probably wreck your engine too you will/should get a brand new subaru supplied engine and turbo out of it lol. If not go down the refusal of sale path and get your money back

Sid hand it back,I was there with you and they wanted the warranty company to pay we gave them a cheap way to resolve the problem that you were happy with but they Hoped the warranty would cover it,he knows it would not but tried,I went with you and gave them an option which they should take,the director agreed so go for it

well sid my vf22 wen t the same way and it was kancked and i was told off loads ov lads on here that it would take my engine out so a wait and got a 18g off jonny and never looked bk since at day just so ya no mate
