| cant believe what a shit day i have had so far . woke upto a knock on the door found a baliff at the front door asking for £1400 in unpaid council tax or he is going the seize the car. found out that my ex hadn't paid any council tax on 2 house we lived in all unbeknown to me as i was working away and left her incharge of the house hold bill.
so at the moment looks like i wont have a scooby much longer , to put it mildly i am fucking gutted | |

| cant as thet know i own the car and they will take it off who ever is the new keeper as they know its just a ploy to keep the car

Bugger ... hmmm won't they accept a payment arrangement? Go at it from the angle you need it to work, if you don't have it to get to work (unsociable hours), you will no longer have a job and then they won't get anything out of you lol |

Try ringing your local citizens advice bureau they may be able to help. |

| I'm pretty certain they cant do that, unless the house debt was solely in your name and they can prove you knowingly avoided payments. | |

| she has been to court and made an agreement and because she hasn't stuck to it they have come after me as the owners of the houses . to make matters worse i had no idea this had even taking place until this morning. as i hadn't recieved any letters saying it was or had been to court .
as i said to the baliff i am being punished for trusting my ex long term partner to pay the bill with my wage . at the time when we were in these houses i was earning £700 a week so there was no reason it wasn't payed
she has obviously just hid letters and hoped it would go away | |

| ask for a copy of the judgement from the court, then apply to have the judgement set aside (costs approx £75), court will then give you a hearing date in front of a judge. If you can prove you provided money for her to pay the bills and provide proof you were actually away (in most cases if you work away for so many days then you are exempt from paying council tax) they can set aside judgement against you and go after her. good luck | |

| Get some legal advice ASAP! Citizens advice may be able to help you free. Taking your car which is worth much more than the debt is just bloomin' wrong. You have had no notification of the debt or court proceedings. Agree with Caryn you need a copy of the judgement before even speaking to the baliff again. I'd lock the car up somewhere as soon as their 'pay by' date comes about too. |

Thing is if they take the car, they will only sell it at auction - and if the value it brings is less than the debt (for arguments sake £200) you would still be liable for the difference. |

| Indeed, that's why I suggested legal advice. Known these morons to take stuff, sell it for very little then still come back to the person for more. The terzo is worth more than that surely.
Has someone got a garage you could store it in for safety sake? |

good luck the hard part is proving that she recieved the money as my pay went into my account and she had the card i came home once a week and took money to cover my living costs while away from home. do i need to apply to the court that dealt with it as i wouldn't have a clue were to start my heads a mess with all this dont know wether i am coming or going all this on top of ptsd . the car is clamped on my drive so i cant even move it | |

| They're not allowed to clamp your car until they have authorisation to claim it! Cut it off! If it's on your drive definately not as that is your property, sure they need authorisation first.
I am sure they must give you a 14 day notice....you need legal advice asap
Many do transfer ownership to someone elses name and get no come back as unless the debt is secured to the car I don't think they can reclaim it from the new owner
They're usually not allowed to take anything needed for your work/job |

| angle grinder will take care of the clamp and Ive got a secure workshop you can store it in till this gets sorted. if shes got the card and was withdrawing cash and you can prove you werent in the vicinity on the days she was taking cash then theres your proof if you dont feel able to deal with this get in touch with the court and ask them how to appoint a litigation friend (its basically somone who will deal with all the paperwork on your behalf but they dont have to be a solicitor) if you dont have anyone I'll do it (never lost a case yet lol) you must contact the court as a matter of urgency - just explain to them whats happened and ask them for help, they are usually pretty helpful | |

| as said, cut the fucking clamp off mate. im sure only government authority figures & DVLA have the right to clamp vehicles! get it in storage somewhere too. car is worth far more than the debt so surely they cant just come and say theyre taking it? get advice ASAP mate! |

| I have a cordless angle grinder in my Caddy and have no problems coming around to yours and cutting that clamp off for you.
Then get the car hidden away until you can sort it out.
How the hell are supposed to pay a bill when they clamp your only means of getting to work - KNOBS!!! :evil: | |

| mrs ds advice is 100% rite, you need to act now tho no delay or its too late, ps if it gets clamped DO NOT cut the fucker off yal only get charged about another grand for the clamp , its unreal the powers that are given to bailiffs esp the ones that work for council, it isnt rossendales by any chance is it? | |
